As a general rule, I don’t endorse the idea of airing private transaction disputes on public forums, so this one will be presented in anonymity as to the counter-party, in order to address the general issue with ebay BIN transactions.

I have always dealt with any ebay transaction, whether a BIN or as high bidder in an auction with the same communication to the seller, immediately upon either hitting BIN or winning the auction: ‘Tell me when you are prepared to ship, and I will paypal funds immediately' – and there has never been more than an hour between seller sending that confirmation and payment sent.

Lately, it has become common for a dialogue box to pop up immediately after hitting a BIN with language to the effect that ‘seller requires immediate payment or your purchase may not be binding, and the item will continue to be offered for sale’.

Five days ago I hit the BIN on a new Tama Lever Glide high hat stand, got this message, and sent funds immediately. There were purportedly three available. Three days later I had heard nothing at all from the seller, and sent an inquiry. Another day later, a second inquiry is sent, and the seller responds that he also has a brick and mortar storefront, and has sold them all.

Meanwhile, he now knows for at least as day that he has an item listed for sale on ebay that he does not have, and the listing still shows two available!

In my opinion, it takes a massive amount of material transfer from cranium to scrotum to continue to list an item with a BIN and require immediate payment, knowing that you do not have the item to deliver. The seller thinks that offering a refund make his position acceptable.

Don’t know what ebay will do with it, but in my mind, this is fraud, regardless of degree, and has been reported as such.

What a strange transaction. Hard to see how it would be fraud unless the intent were to steal your money, but even temporary use of your money under false premises could constitute fraud. How can a person have time to refund your money but not the time to take a listing down? Also wonder, in this age of instant communications, websites and the like, how a business hopes to maintain a reputation of straight dealings? Sonor 'finishes' come to mind. Kinda makes one want to say "Fork off !"

I have had it happen to me a few times Cliff except it didn't go as far as paying.
I would just simply ask a question about the item and get a response that there is none left.
And still did not see the auctions get removed.
